RVM LAW, LLC OBTAINS SUCCESSFUL DEFENSE VERDICT ON CIVIL THEFT, COLORADO ORGANIZED CRIME ACT, CIVIL CONSPIRACY AND JOINT LIABILITY UNDER C.R.S. § 7-122-104 CLAIMS
RVM Law, LLC successfully defended a client on a contentious two year lawsuit involving disputes over control of a non-profit veterans’ organization culminating in a five day jury trial in Jefferson County District Court. Prior to the trial the court granted RVM Law, LLC’s motion for partial summary judgment on claims for fraudulent representation, conversion, tortious interference with contractual relationships. At trial the remaining claims of civil theft, violations of the Colorado Organized Crime Act, Civil Conspiracty, and Joint and Several Liability under C.R.S. § 7-122-104.
The jury found RVM Law. LLC’s client was not liable for civil conspiracy or Colorado Organized Crime Act violations. The jury found liability for civil theft and joint and several liability under C.R.S § 7-122-104, but awarded zero dollars in damages resulting in a defense verdict with no damages of any kind awarded to the plaintiff. The plaintiffs in the case sought approximately a million dollars in damages in the case against Plaintiff’s client in their closing arguments to the jury.
In a post-trial ruling the court imposed $200.00 in statutory damages and attorney’s fees and costs in favor of plaintiff’s on the civil theft claim which was then appealed to the court of appeals which upheld the ruling. RVM Law, LLC further awarded the award of attorney’s fees and costs and as of today the plaintiffs have not collected on the cost and fee award.
